Unless otherwise stated, Beast Putty and/or its licensors own the intellectual property rights for all material related to Beast Putty. All intellectual property rights are reserved. You may view and/or print pages from beastputty.com for your own personal use subject to restrictions set in these terms and conditions.

User Comments

Product Use

Beast Putty is intended for use as described on the product packaging. Improper use of the product outside of its intended use is not recommended and Beast Putty will not be held liable for any damages resulting from such misuse.

Indemnity

You hereby indemnify Beast Putty and undertake to keep Beast Putty indemnified against any losses, damages, costs, liabilities, and expenses (including without limitation legal expenses and any amounts paid by Beast Putty to a third party in settlement of a claim or dispute on the advice of Beast Putty's legal advisers) incurred or suffered by Beast Putty arising out of any breach by you of any provision of these terms and conditions.

Disclaimer of Warranties

Except where prohibited by applicable law, Beast Putty products and this website are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Beast Putty disclaims all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Beast Putty does not warrant that the website will be uninterrupted, secure, or error-free. Nothing in these terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including the statutory rights of consumers.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Beast Putty, its officers, directors, employees, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the products or this website, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if Beast Putty has been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Beast Putty's total aggregate liability for all claims arising out of or relating to the products or these terms will not exceed the greater of (a) the total amount you paid to Beast Putty for the product giving rise to the claim in the twelve (12) months preceding the event giving rise to liability, or (b) five U.S. dollars (US$5.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you; in such cases Beast Putty's liability will be limited to the maximum extent permitted by law.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

Variation

Beast Putty shall have the right in its absolute discretion at any time and without notice to amend, remove, or vary the Services and/or any page of its website and these Terms and Conditions.

Entire Agreement

These terms and conditions, together with Beast Putty's Privacy Policy, constitute the entire agreement between you and Beast Putty in relation to your use of this product and supersede all previous agreements in respect of your use of this product.

Law and Jurisdiction

These terms and conditions will be governed by and construed in accordance with the laws of the United States of America, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the United States of America.
